[Bug]: In 1.37.0 File Compare is missing after update

In 1.37.0 File Compare is missing after update

When I have a SQL query which returns JSON. Click the on JSON it will now open as a .json file when before it was untitled file.

Doing the means when clicking two open JSON file the file compare is missing.

Steps to Reproduce

1. Run SQL Query which returns JSON.
2. ctrl + left click on JSON, to open two tabs
   3.) Right click
   4.) compare option missing

They I've closed the issue with vscode, and told me to raise it here.
